Summary
Nimbus Healthcare Corporation ("Nimbus Healthcare", "Nimbus", "we", "us" and "our") sends text messages about your account and your care. We send marketing text messages only if you give separate consent. Consent to receive text messages is not a condition of purchase. Message frequency varies, and message and data rates may apply. Reply STOP to opt out, or reply HELP for help.
About our texting program
These SMS Terms describe the text message program that Nimbus runs for the Services. Capitalized terms that these SMS Terms do not define have the meaning given in the Terms of Use. When you give us your mobile number and agree, we may send you:
- Account messages, such as sign-in codes and notices about your account.
- Care messages, such as a notice that a licensed clinician has sent you a message, or an update about an order.
- Marketing messages, such as news and updates about Nimbus Healthcare and the Patient Programs, but only if you have given separate consent.
Do not use text messages for an emergency. In an emergency, call 911.
Your consent
By giving us your mobile number and agreeing to receive text messages, you consent to receive account and care text messages from us at that number.
Marketing messages need separate consent. We ask for that consent on its own, and we do not combine it with your agreement to the Terms of Use, with a purchase or with your care. You can withdraw it at any time.
Consent is not a condition of purchase. Consent to receive text messages is not a condition of purchasing any goods or services from us.
We send text messages in line with the Telephone Consumer Protection Act and other applicable laws.
Message frequency and rates
Message frequency varies. The number of messages you receive depends on your account activity, your care and your choices.
Message and data rates may apply. Your mobile carrier may charge you for messages and data under your mobile plan.
How to opt out and how to get help
To opt out, reply STOP to any message. We send one message to confirm your request, and then we stop sending text messages to that number. We also honor QUIT, END, REVOKE, OPT OUT, CANCEL and UNSUBSCRIBE, and any other reasonable way you tell us that you want texts to stop, including an email to support@nimbushealthcare.com. We process your request promptly and no later than ten business days after we receive it. Opting out does not close your account, and we may still contact you by other means, such as email, about your account and your care.
For help, reply HELP to any message, or email support@nimbushealthcare.com.
Carriers and delivery
Carriers and their affiliates are not liable for delayed or undelivered messages.
Privacy
We handle your mobile number and the information in your messages as described in the Privacy Policy. Mobile telephone numbers and text-message opt-in information are never shared with or sold to third parties or affiliates for their own marketing purposes.
Changes to these SMS Terms
We may change these SMS Terms by posting a new version on this page. If a change affects your consent, we will ask for your consent again where the law requires it.
Dispute resolution
Disputes relating to this document are resolved as described in the Dispute resolution and arbitration section of the Terms of Use, which is incorporated by reference.
